<br />::. <br /> <br />~ <br /> <br />Upper Colorado River Basin Compact of 1948 <br /> <br />Additio~al subparagraphs and paragraphs (c) and (d) address the use <br />of water in excess of the apportionment and prohibit deprivation of the <br />use of another State's apportioned water by such use, and prohibit <br />establishment of any right to continued use of excess water. <br /> <br />Article ~ i!l and~. These paragraphs address the allocation of <br />reservoir evaporation quantities among the States. <br /> <br />Article ~ill. "In the event ... a reservoir site is available both to <br />assure deliveries at Lee Ferry and to store water for consumptive ~ in <br />a State of the Upper Division, the storaRe of water for consumptive ~ <br />shall be Riven preference. Any reservoir or reservoir capacity used to <br />assure deliveries at Lee Ferry shall by order of the Commission be used <br />to store water for consumptive ~ in a State, provided the Commission <br />finds that such storaRe is reasonably necessary to permit such State to <br />make the use of the water apportioned to it by this Compact." <br /> <br />Article VII. "The consumptive ~ of water by the United States of <br />America shall be charged as a use by the State in which the use is <br />made; provided, that such consumptive use incident to the diversion, <br />impoundinR, or conveyance of water in one:state for use in another shall <br />be charged to such latter State." <br /> <br />Articles ~ XI, XII, XIII, and XIV. These articles apportion the waters <br />of certain tributaries of the Colorado River between~the pairs of States <br />which share them. All refer to consumptive ~ at least once, and <br />depleted flow is mentioned in Article XIII. The article, stream, and <br />State pairs are: <br /> <br />X, LaPlata River, Colorado and New Mexico (an existing compact <br />is recognized). <br /> <br />XI, Little Snake River, Colorado and Wyoming. <br /> <br />XII, Henry's Fork, Utah and Wyoming. <br /> <br />XIII, Yampa River, Colorado and Utah. <br /> <br />XIV, San Juan River, Colorado and New Mexico. <br /> <br />Article XV, i!l. "Subject to the provisions of the Colorado River <br />Compact and of this Compact, water of the Upper Colorado River System <br />may be impounded and used for the generation of electrical power, but <br />such impoundin~ and ~ shall be subservient !2. ~ ~ and consumption <br />of ~ water for aRricultural and domestic purposes and shall not <br />interfere with ~ prevent ~.for such dominant purposes." <br /> <br />2 <br />
