S 85-2-316 <br /> <br />Nebraska <br />Neb. Rev. Stat. S 46-2,107 et ~. <br /> <br />Oregon <br />Or. Rev. Stat. S 536.310 <br /> <br />Beneficial uses include "...appropriation <br />by the state of Colorado....of such minimum <br />flows....as are required to preserve the <br />natural environment to a reasonable <br />deg ree . . . . <br /> <br />The Montana Water Board "shall limit reser- <br />vation after May 9. 1979 for maintenance of <br />minimum flow, le~el or quality of water that <br />it awards at any point on a stream or river <br />to a maximum of 50% of the average annual <br />flow of record on gauged streams." <br /> <br />"The Legislature finds that the maintenance <br />conservation, management, storage and timely <br />release of the waters of the natural streams <br />within the State of Nebraska are in the pub- <br />lic interest and are practices essential to <br />the well-being of present and future genera- <br />tions. In furtherance of these practices, <br />the public interest demands the recognition <br />of instream uses for fish. recreation, and <br />wildlife. The legislature also finds that <br />proposals for future water development should <br />fully consider multiple uses. including in- <br />stream flows whether from natural flow or <br />from reservoir releases, and recognizes the <br />positive impact of impoundments which can <br />provide significant instream flow benefits." <br /> <br />...An instream appropriation may be obtained <br />only by the Nebraska Natural Resources Com- <br />mission and only for that amount of water <br />necessary for recreation or fish and wild- <br />life. N <br /> <br />"...the board shall take into considera- <br />-tion....the following....declarations of <br />policy: (7) The maintenance of minimum <br />perennial stream flows sufficient to support <br />aquatic life and to minimize pollution shall <br />be fostered and encouraged.... <br />
