Clean Water Act - Section 404 <br />1. 404 permits generally, and wetlands concern in <br />particular, are a major restraint for any water <br />proj ect. The diff icul ty and expense of doing an <br />adequate environmental review is a significant <br />hurdle at best. The Two Forks decision has <br />dramatized the real substantive teeth of the 404C <br />veto process. <br />Wetlands protection under 404 has a tendency to <br />particularly restrain . develop~ent of water <br />projects; reservoir sites in the bottoms of valleys <br />with natural dam sites have a tendency to be <br />wetlands: willow.carrs, grass dominated wetlands <br />and low cottonwood flood plains are all favorites. <br />The current administrative proposal for revision of <br />the . wetlands delineation manual has created <br />considerable political storm and has not been <br />finally resolved. Despite extensive comment <br />against the revision, the rulemaking, process is <br />still on track.
