AGREEMENT FOR USE OF <br />ABANDONED TEST HOLE OR WELL <br />THIS AGREEMENT is entered into this day of <br />19 , by and between <br />hereinafter called "Licensor," and the United States of America, by and through the <br />U.S. Geological Survey, U.S. Department of the Interior, hereinafter called "Licensee," <br />pursuant to the Act of December 24, 1942, as amended (43 U.S.C. Sec. 36b). <br />WITNESSETH: <br />1. Licensor, for and in consideration of the faithful performance by Licensee of all <br />covenants and conditions herein contained and payment of the amount hereinafter provided, <br />hereby consents and agrees to the exclusive use of the abandoned test hole or well for.the <br />collection of geohydrologic data in the interval from the land surface to a depth -of feet. <br />2. The said test hole or well is located and described as follows: (name, location and <br />description) <br />3. This agreement is valid only upon the condition that the landowner, estate, or <br />proper authority grants the right of ingress to and egress from the said test hole or well and <br />surrounding work area. <br />4. This agreement is valid only upon the condition that the (state plugging regulatory <br />agency) <br />has accepted the plugging requirements agreed upon by the Licensor and Licensee. <br />5. The Licensor will complete all plugging required by the state plugging authority <br />up to and including a cement plug in the bottom of the surface casing. No plugs would be <br />set in the surface casing between the bottom plug and the surface, and a metal cap would <br />be installed on the top of the casing. <br />6. Use of the test hole or well by the Licensee shall begin after days of <br />a mutually agreeable time after the effective date of this agreement. <br />7. As consideration for the rights and privileges granted herein, the Licensee shall <br />pay to the Licensor the sum of $ upon presentation of bill therefore, <br />subject to the availability of appropriations by the Congress. <br />8. The Licensee can cannot (cross out the one that does not apply) deposit in the mud <br />pit(s) the drilling fluid removed from the test hole or well after the Licensor has ceased all <br />drilling and associated operations and abandoned the drill site except for restoring the site <br />to as nearly as possible the same condition existing prior to drilling or to a condition agreed <br />upon by the landowner, estate, or proper authority. <br />Figure 2.
