(a certain ditch company and <br />specifying other ditch rights). <br />The Colorado Supreme Court, in Denver Joint Stock Land Bank v. <br />Markham, 106 Colo. 509, 107 P.2d 313 1940 , held that only the <br />specifically described rights in the deed had been conveyed. <br />Thus, be sure to accurately describe each and every right you in- <br />tend to buy or sell. <br />In conclusion, the purchase or sale of a water right should be <br />approached with great caution. Only by careful review of the ap- <br />plicable law and available evidence of title will you avoid the <br />many pitfalls in this type of transaction. If you have any seri- <br />ous problems on any of the above-mentioned issues, expert advice <br />should be sought. <br />-29-
