<br />Administrative Support to the Governance Committee and Executive Director for the Platte River Endangered Species
<br />Partnership
<br />TBIS AMENDMENT, made this -3 day of 2iL??t&/,2003, by and between the State of Colorado for the use
<br />and benefit of the Department of Natural Resources, Colorado Water Conservation Board, 1313 Sherman Street, Room
<br />721, Denver, CO 80203, hereinafter referred to as the State, and Nebraska Com. nunity Foundation, 317 South 12`h Street,
<br />Suite 200, Lincoln, NE 68508, hereinafter referred to as the contractor,
<br />FACTUAL RECITALS
<br />Authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made available and a sufficient
<br />unencumbered balance thereof remains available for payment; and
<br />Required approval, clearance, and coordination has been accomplished from and with appropriate agencies; and
<br />The parties entered into a contract dated July 1, 1999, for financial management and administrative support in the
<br />implementation of the July 1997 Cooperative Agreement for Platte River Research and Other Efforts Relating to
<br />Endangered Species Habitats Along the Central Platte River, Nebraska, the purpose for this amendment is described
<br />belaw.
<br />WHEREAS, the parties mutually agree that the contract performance period needs to be extended until March 31, 2004 to
<br />a11ow additional time to complete an Endangered Species Program;
<br />NOW THEREFOKE, it is hereby agreed that
<br />1. Consideration for this amendment to the original contract, (PDA 00-00002 Contract Routing Number), (Contract
<br />l?ncumbrance Number, C153878, dated July 1, 1999 consists of the payments which shall be made pursuant to this
<br />amendment and the promises and agreements herein set forth.
<br />2. lt is expressly agreed by the parties that this amendment•is supplemental to the original Contract Routing Number
<br />(:153878 dated July 1, 1999, as amended, April 6, 2001, Contract Routing Number 41 PDA 00064 referred to as the
<br />" original contract," which is, by this reference, incorporated, and made a part hereof, and all terms, conditions, and
<br />provisions thereof, unless specifically modified herein, are to apply to this amendment as though they were expressly
<br />rewritten, incorporated, and included herein.
<br />3. It is agreed the original contract is and shall be modified, altered, and changed in the following respects only:
<br />a. B.5 Performance Period: The period of performance under this agreement is extended though March 31, 2004
<br />b. No State or other public funds payable under this Contract shall be used for the acquisition, operation or
<br />maint:enance of computer software in violation of United States copyright laws or applicable licensing restrictions. The
<br />Conti-actor hereby certifies that, for the term of this Contract and any extensions, the Conh-actor has in place appropriate
<br />systems and controls to prevent such improper use of public funds. If the State determines that the Contractor is in
<br />violation of this paragraph, the State may exercise any remedy available at law or equity or under this Contract, including,
<br />without limitation, immediate termination of the Contract and any remedy consistent with United States copyright laws or
<br />applicable licensing restrictions.
