a. This agreement shall take effect upon the latest date shown in tlle signature blocks 15 through 19 on the Assistance Agreement Form 7-2277. b. This agreement shafl remain in effect tllrough September 30, 2000, unless the agreement is extended, modified or terminated after execution. B.6. A1v10UNT OF THE AGREEMENT a. For providing services pursuant to this agreement, the Foundation shall be reimbursed for its expenses as follows: charge Reclamation and the States a stiding scale percentage rate which in turn is based upon the combined fund balances of Reclamation and the States at the time of disbursement. These fees ace to cover financial management and personnel/contracts management services: • Combined Fund Balance Percentage Charee $0 to $4,999 , . No Fee/No Earnings $5,000 to $49,999 3.5% $50,000 to.$99,999 3.0% $100,000 to $249,999 2.5% $250,000 to $499,999 2.0% . $500,000 and above 1.0% Note: For example, if a$5,000 disbursement was requested when the combined fund balances were S100,000, a fee .of $125 would be assessed. ' . b. Unless otherwise directed by the Go.vernance Committee, the fees shall be shared by the Parties based on the percentages cited in B.2.g., above. c. This agraement creates no obligation of the States or Reclamation for contribution of funds beyond that specified in the July 1997 Agreement and as may be made available by appropriation. Funding far the Foundation activities will be provided from funds to be contributed by the States and Federal Government in accordance with the July 1997 Agreement. d. The Foundation's cost of providing its services may only be increased by decision of the Governance Committee and concurrence by Reclamation and the States. The Foundation shall provide a 60-day advance written notice to the Executive Director, Grants and Cooperative , Agreements Officer, and the States if it anticipates that the tiudgeted amount for a given period will be insufficient. All costs incurred by the Foundation beyond the budget amount for the periods specified above prior to .the required approval sha11 be borne by and become the sole responsibiliry of the Foundation. e. The Parties are committed to a mutual cooperative effort to share anticipated budget and expenditure trends with t6e Foundation in the interests of maintaining. a smooth working relationship on a day-to-day basis.
