<br />T13IS AMENDMENT, made this day of 2004, by and between the State of Colorado for the use
<br />ar;d benefit of the Department of Natural Resources, Colorado Water Conservation Board, 1313 Sherman Street, Room
<br />72 1, Denver, CO 80203, hereinafter referred to as the State, and Nebraska Community Foundation, 317 South 12'h Street,
<br />Suite 200, Lincoln, NE 68508, hereinafter refened to as the contractor,
<br />FACTUAL RECITALS
<br />Atxthority exists in the Law and Funds have been budgeted, appropriated, and otherwise made available and a sufficient
<br />unencumbered balance thereof remains available for payment; and
<br />Required approval, clearance, and coordination has been accomplished from and with appropriate agencies; and
<br />Tl-,e parties entered into a contract dated July 1, 1999, for financial management and administrative support in the
<br />implementation of the July 1997 Cooperative Agreement for Platte River Research and Other Efforts Relating to
<br />Endangered Species Habitats Along the Central Platte River, Nebraska, the purpose for this amendment is described
<br />be.low.
<br />W;G-IEREAS, the parties mutually agree that the contract performance period needs to be extended until March 31, 2006 to
<br />allow additional time to complete an Endangered Species Program;
<br />NOW THEREFORE, it is hereby agreed that
<br />1. Consideration for this amendment to the original contract, (PDA 00-00002 Contract Routing Number), (Contract
<br />Encumbrance Number, C153878, dated July l, 1999 consists of the payments which shall be made pursuant to this
<br />amendment and the promises and agreements herein set forth.
<br />2. It is expressly agreed by the parties that this amendment is supplemental to the original Contract Routing Number
<br />C153878 dated July 1, 1999, as amended, April 6, 2001, Contract Routing Number 01 PDA 00064, and as amended
<br />November 3, 2003 Contract Routing Number 04 PDA 00035 referred to as the "original contract," which is, by this
<br />reference, incorporated, and made a part hereof, and all terms, conditions, and provisions thereof, unless specifically
<br />modified herein, are to apply to this amendment as though they were expressly rewritten, incorporated, and included
<br />herein.
<br />3. It is agreed the original contract is and shall be modified, altered, and changed in the following respects only:
<br />a. B.1 Services to be Provided as a Contracting Agent: The funds budgeted to perform additional professional
<br />services, as a result of the time extension, is amended and shown in Attachment IV - 1 and Colorado's
<br />portion of the budget is increased by $37,490.00 Fund 100, Appropriation Code 018. The total funds
<br />budgeted for the entire contract is $737,489.00.
<br />b. 13.5 Performance Period: The period of pertarmance under this agreement is extended though March 31,
<br />2006.
