<br />THIS AMENDMENT, made this ?A?day of (y4rCA-N 2006, by and between the State of Colorado for the use
<br />anci benefit of the Department of Natural Resources, Colorado Water Conservation Board, 1313 Sherman Street, Room
<br />72 l, Denver, CO 80203, hereinafter referred to as the State, and Nebraska Community Foundation, L
<br />-gttite 299; Lincoln, NE 68508, hereinafter referred to as the contractor,
<br />a- FACTUAL RECITALS
<br />Authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made available and a sufficient
<br />unencumbered balance thereof remains available for payment; and
<br />Reiluired approval, clearance, and coordination has been accomplished from and with appropriate agencies; and
<br />Thi,- parties entered into a contract dated July l, 1999, for financial management and administrative support in the
<br />implementation of the July 1997 Cooperative Agreement for Platte River Research and Other Efforts Relating to
<br />Eniiangered Species Habitats Along the Central Platte River, Nebraska, the purpose for this amendment is described
<br />bel ow.
<br />V1IIEREAS, the parties mutually agree that the contract performance period needs to be extended until December 31,
<br />2006 to allow additional time to complete an Endangered Species Program;
<br />NOW THEREFORE, it is hereby agreed that
<br />1. Consideration for this amendment to the original contract, (PDA 00-00002 Contract Routing Number), (Contract
<br />Encumbrance Number, C153878, dated July 1, 1999 consists of the payments which shall be made pursuant to this
<br />amendment and the prornises and agreements herein set forth.
<br />2. It is expressly agreed by the parties that this amendment is supplemental to the original Contract Routing Number
<br />C153878 dated July 1, 1999, as amended, April 6, 2001, Contract Routing Number 01 PDA 00064, as amended
<br />November 3, 2003 Contract Routing Number 04 PDA 00035, and as amended March 31, 2006, refened to as the
<br />"original contract," which is, by this reference, incorporated, and made a part hereof, and all terms, conditions, and
<br />provisions thereof, unless specifically modified herein, are to apply to this amendment as though they were expressly
<br />rewritten, incorporated, and included herein.
<br />3. It is agreed the original contract is and shall be modified, altered, and changed in the following respects only:
<br />a. 13.1 Services to be Provided as a Contracting Agent: The funds budgeted to perform additional professional
<br />services, as a result of the time extension, is amended and shown in Attachment IV - 1 and Colorado's
<br />portion of the budget is increased by $37,489.00 Fund 100, Appropriation Code 018. The total funds
<br />budgeted for the entire contract is $777,978.00.
<br />b. 6.5 Performance Period: The period of performance under this agreement is extended though June 30,
<br />2007.
