1 14 FERC Q 62, 1' 9 8 <br />UNITEB STATES OF AMERICA <br />FEDERAL ENERGY REGULATORY COMMISSION <br />CenU•al Nebraska Public Power & Inigation District Project No. 1417-170 <br />ORDER APPROVING NORTH PLATTE RIVER/KELLY TRACT THREE-YEAR <br />REPORT PURSUANT TO ARTICLE 419 <br />(Issued February 28, 2006) <br />On October 4, 2005, Central Nebraska Public Power & Irrigation District <br />(licensee) filed a three-year report for the North Platte River/Kelly Tract as required by <br />pazagraph (B) of the Order Approving Restoration and Management Plan for the North <br />Platte River/Kell? Tract Pursuant to Article 419 for the Kingsley Dam Project, issued on <br />March 13, 2002. The project is located on the North Platte and Platte Rivers in Keith, <br />Adams, Gosper, Phelps, Kearney, Lincoln, and Dawson Counties, Nebraska. <br />Paragraph (B) requires the licensee to file a three-year report summarizing habitat <br />monitoring and adaptive management to date and an expenditure summary, for <br />Commission approvaL Additional reports will be due every five years thereafter. A draft <br />of the report should be sent to the U.S. Fish and Wildlife Service (FWS) and the <br />Nebraska Game and Parks Commission (NGPC) for review and comment, prior to filing <br />the report with [he Commission. <br />The North Platte River/Kelly Tract is managed by The Natwe Conservancy (TNC) <br />and the report was pcepared by the TNC and the licensee. In its filed plan, summarizing <br />activities that occurred between 2002 and 2004, the licensee listed the restoration <br />activities and costs, maintenance activities and costs, and monitoring activities and costs. <br />The licensee also included copies of each of the annual monitoiing reports that had been <br />provided to the resource agencies. In an appendix, the licensee included a Five-Year <br />Management Plan for April 2005-March 2010 for The Nature Conservancy's North <br />Platte River/ Kelly Tract. <br />The licensee provided the agencies a copy of the draft report on August 9, 2005. <br />In its letter dated September 15, 2005, the FWS concuned with the report and had no <br />objecrions to how the North Platte River/Kelley Tract will be managed for the next five <br />years. The NGPC provided comments in a letter dated September 19, 2005, stating it had <br />no comments on the acGvities report, although, they provided comments on the Five-Year <br />? Project No. 1417-170 - 2 - <br />Management Plan. The licensee and TNC incorporated the NGPC's comments into the <br />plan and adequately addressed those comments that were not added directly into the plan. <br />The North Platte River/Kelly Tract Three-Year Report shows that the licensee has <br />been complying with the requirements of the approved restoration and management plan. <br />The filed report satisfies the first reporting requirement of paragraph (B) of the 2002 <br />Order, and should, therefore be approved. <br />The Director orders: <br />(A) The North Platte River/Kelly Tract Three-Year Report, filed October 4, 2005, <br />required by with paragraph (B) of the Order Approving Restoration and Management <br />Plan for the North Platte River/Kelly Tract Pursuant to Article 419, is approved. <br />(B) This order constitutes final agency action. Requests for rehearing by the <br />Commission may be filed within 30 days of the date of issuance of this order, pursuant to <br />18 C.F.R. § 385.713. <br />,c.< QC???`???e„ <br />John E.
