Section by Section Section 1 Short Title: Platte River Recovery Implementation Program and Pathfinder Modification Authorization Act of 2006. Title 1 Sec 101 Purpose States that the Purpose of the act is to implement the Platte River Recovery Implementation Program for threatened and endangered species in the Central and Lower Platter River Basins. Sec 102 Deflnitions Sec 103 Implementation Authorizes the Sectary and the Program Governance committee to participate in the program and carry out projects to implement the program including ability to: Enter into contracts Acquire from willing sellers interests in land, water, and facilities - without use of eminent domain Accept or provide grants Sec 104 State Share of Program Costs States shall pay at least 50% of the costs of the program including at least 30 million in non-Federal funds Authorizes types of contributions from the states including donations of land, water and, in-kind Contributions Requires that the value of land, water, or in-kind services be adjusted for inflation yearly. Sec 105 Authority to Modify Program Give Sec authority to modify the program if they deternune that modifications are consistent with the purpose of the program. Sec 106 Effect on the Reclamation Laws States that nothing in the act: Be considered when determining whether a district has met their obligation to repay construction costs of proj ect facilities used to make irrigation water available Be the basis for reinstating acreage limitations in a district that has completed payment of their construction obligations Be the basis for increasing construction repayment obligations of the district which would extend the time when acreage limitation provisions apply.
