e. The SWA recharge projects will probably be needed in the early years.
Over time, it may be discovered that using conventional reservoirs,
constructing other recharge projects, or leasing recharge credits frorn
recharge plans that have already been decreed and constructed by i:hird
parties, either is necessary to achieve the full extent of re-regulation
required, or is a more cost effective substitute for all or part of the
Tamarac plan. Does it matter to DoW if other alternative are selected to
fulfifl part of the PRRIP obligations, or if such use of the SWA's is phased
out completely over time?
f. If the SWAs will be used to meet PRRIP obligations, even temporarily,
several additional issues need to be agreed upon, probably in a separate
MoA:
i Who should own the pumping and recharge facilities?
ii What percentage of construction and O&M costs should be paid by
SPWRAP, and should it pay any other costs?
iii Are there benefits to DoW from operation of the recharge facilities, on
these lands? If so, should that afFect the cost sharing between the
State and SPWRAP?
iv What provisions are necessary for the protection of DoW if a deci:sion
is made to transition to other means of ineeting PRRIP obligations
sooner than anticipated?
g. Leasing of recharge credits may be more cost effective in the short tE:rm.
In the long term, there may be economic or other advantages to owning
the land and facilities needed. At some point, a decision will have to be
made as to which approach, or what combination of approaches, should
be pursued.
h. Although most aspects of the use of SWAs to meet program requirerrients
should be addressed in the separate agreement devoted to that issue, the
overall agreement befinreen the State and SPWRAP should spell out how
the larger decisions will be made, who will pay the costs associated with
the re-timing of water, and who will hold title or any residual interest iri the
event the Program is terminated.
4. Program Accounting Obligations
a. Decision needed: How specific must this agreement be regarding the
primary and secondary collection and processing of data required for the
PRRIP, and which of the State agencies need to be signatories to the
agreement between the State and SPWRAP?
?
