LAND INTEREST HOLDING ENTITY SUMMARY <br />Following discussion which eliminated banks from consideration to serve as the LIHE, <br />we created a list of non-profits and questions to be asked in researching their abilities and <br />interest in serving as the LIHE. <br />Introduction: The Platte River Recovery Program will be acquiring land by fee title <br />purchase, leases, and easements. We intend to identify an entity to hold the titles, leases, <br />and easements on behalf of the Program through an agreement with the Bureau of <br />Reclamation and the States of Nebraska, Colorado, and Wyoming. In addition to holding <br />the titles and documents, the entity would pay the taxes for the owned lands and would <br />carry liability insurance for potential events on the lands. Activity on the lands and all <br />transactions related to the lands will be the exclusive responsibility of the Program's <br />Governance Committee. <br />The Platte River Recovery Program goals are to aid in the recovery of three endangered <br />and threatened bird species (whooping crane, piping plover, and least tern) along the <br />Platte River in central Nebraska and one fish species (pallid sturgeon) in the Platte River <br />near its confluence with the Missouri River in eastern Nebraska. The Program provides <br />for acquisition of 7,350 acres of land along the Platte River as species' habitat. It is <br />expected that this will include fee title purchases and very likely some sales, as well as <br />leases and easements. If the program terminates for any reason, an exit strategy, including <br />sales of the owned lands with the assets returning to the Program Partners is provided for <br />in the Program agreement. <br />Questions; <br />Are you able/willing to hold title to land in Nebraska for the Platte Program? <br />Could you also hold leases and easement agreements? <br />Could you pay taxes and maintain liability insurance? <br />What are your goals? (Are they consistent with the goals of the Recovery <br />Program?) <br />Do you have established internal approval processes which could limit your <br />ability to hold lands for the Recovery Program? <br />What would your internal process be to accept deeds held for the Program? <br />How would you propose to charge fees for these services? <br />Can you provide these services in perpetuity? <br />Would you be agreeable to a predetermined succession procedure if you were to <br />become unable or unwilling to provide the services? <br />If an exit strategy is implemented, would your procedures prevent timely <br />disposal/sales of property or property shares by the Program Partners? <br />The Entities and Contacts: <br />Organization Contact Caller(s) <br />Audubon Society Jim <br />Center of Natural Lands Trust Larry
