G. This Agreement is made for the purpose of providing S,4 i 2.5 acre-feet of water <br />annually to the 15-Mile Reach for an interim period often (] 0} years. <br />H. Denver Water contemplates entering into a similar agreement with the Service for <br />providing an additional 5,412.5 acre-feet of water annually to the 15-Mile Reach for <br />an interim period of ten (10) years (the "Denver Water/Service Agreement"} in <br />accordance with Appendix C to the PBO. <br />I. In a letter to Ralph Morgenweck dated September 16,1998, the Colorado water users <br />described a "[c]ontingent agreement on a plan for providing the 10,825 acre-feet of <br />water for the fish that the Service identified as being needed to offset the impacts of <br />the Category 1, depletions." The plan defined an interim solution and a permanent <br />solution for providing the 10, 825 acre-feet of water. This Agreement and the Denver <br />Water/Service Agreement only address the interim solution and do not modify the <br />water users' commitment to provide the permanent solution for the 10, $25 acre-feet <br />ofwater. <br />II. Agreements <br />A. Rights and Responsibilities of the River District <br />1. The River District will release 5,412.5 acre-feet of water per yeaz in <br />accordance with Appendix C in the. PBO. The River District's primary <br />sources ofwater will be Wolford Mountain Reservoir (West Slope pool); and <br />unused Ruedi Round I and Round II contracted water which the River <br />District or other Western Slope parties may have available, and which the <br />Bureau of Reclamation has approved for lease for this purpose. Other <br />sources may be used from time to time. . <br />2. The River District may use existing or future water rights and priority dates <br />to fill, in accordance with existing or future rights or during free river periods, <br />the space in Wolford Mountain Reservoir which is vacated by the release of <br />the 5,412.5 acre-feet ofwater. <br />S. Reliability of the 5,412.5 Acre-Feet During a Drought <br />1. ~ During some drought conditions, the 5,412.5 acre-feet of interim water <br />contemplated in this Agreement may be reduced or eliminated due to the <br />following described hydrology conditions beyond the control of the parties. <br />The River District reserves the right to reduce releases of the 5,412.5 acre- <br />feet of water contemplated by this Agreement in the event of a drought <br />affecting Ruedi and/or Wolford Mountain Reservoirs. <br />-2- <br />
