Page 1 <br />Contract No. OS-WC-40-420 <br />RECOVERY h~~IPLEMENTATION PROGRAM <br />UPPER COLORADO RIVER BASIN <br />AGREEMENT AMONG THE <br />L"NIT'ED STATES OF AN~RICA, DEPARTMENT OF IN'T`ERIOR <br />BUREAU OF RECLAMATION and FISH AI`TD WILDLIFE SERVICE, <br />AND <br />THE COLORADO RIVER WATER CONSERVATION DISTRICT <br />CONCER1v~G ELKHEAD RESERVOIR ENLARGEMENT <br />TO <br />FACILITATE RECOVERY OF ENDANGERED FISH SPECIES IN THE <br />YAMPA RIVER BASIN <br />~~ ~~ <br />C This RESERVOIR E1~TLARGEME?`T'T AGREEMENT made this 17~' day of February <br />~~ <br />~- 200 _ pursuant to the Act to Authorize the Bureau of Reclamation to Provide Cost Sharing for <br />t e Endangered Fish Recovery Implementation Programs for the Upper Colorado and San Juan <br />Ri~-er Basins, (October 30, 2000, 114 Stat. 1602, Public Law 106-392 ), and acts amendatory <br />thereof or supplementary thereto, between the UNITED STATES OF AIVIERICA, <br />DEPARTMEI~T'T OF II~TT'ERIOR, BUREAU OF RECLAMATION ("Reclamation") and the <br />FISH AI~~ WILDLIFE SERVICE ("Service''), both acting through the Secretary of Interior, and <br />the COLORADO RIVER WATER CONSERVATION DISTRICT, acting by and through its <br />Colorado River Water Projects Enterprise ("River District") created pursuant to C.R.S. §§ 37- <br />4~.1-101 and 37-46-101, et seq. <br />WITNESSETH, that: <br />1. V~THEREAS, the Recovery Implementation Program for Endangered Fish Species <br />in the Upper Colorado River Basin ("Recovery Program") dated September 29, 1987 was <br />implemented by a Cooperative Agreement signed in January of 1988 by the Secretary of the <br />Department of the Interior, the Governors of the States of Colorado, Utah, and Wyoming and the <br />Administrator of the ~~Testern Area Power Administration. The Recovery Program is a coalition <br />of agencies and organizations. The goal of the Recovery Program is to recover four species of <br />endangered fish v~~hile allowing water development to proceed consistent with state water law <br />and in compliance with the Federal Endangered Species Act ("ESA"} in the Upper Basin states <br />of Colorado, Utah, and «Tyoming; and <br />2. `VHEREAS, the River District is a political subdi~~ision of the State of Colorado <br />created and existing pursuant to its Organic Act, C.R.S. §§ 37-46-101, et seq., and other <br />I:=20.O~Clients~.River Districf~ i-Elichead-1028 ~A~-eemenu=Reservoir Enlargement A~eert~ent fmal.wpd <br />Apnl ~, 2005 <br />
