evaluation on the premises of the Recipient or asub-recipient, the Recipient shall furnish and <br />shalt require sub-recipients to furnish all reasonable facilities and assistance for the safe and <br />convenient performance of these duties. <br />18. AUDIT (Reclamation 09/03} <br />Recipients are responsible for obtaining audits in accordance with the Single Audit Act <br />Amendments of 1996 {31 U.S.C. 7501-7507) and revised OMB Circular A-133, "Audits of <br />States, Local Governments, and Non-Profit Organizations." Audits shall be made by an <br />independent auditor in accordance with generally accepted government auditing standards <br />covering financial audits. Additional audit requirements applicable to this agreement are found <br />at 43 CFR 12.66 or 43 CFR 12.926, as applicable. General guidance on the single audit <br />process is included in a pamphlet titled, "Highlights of the Single Audit Process" which is <br />available on the Internet at http://www.dot.gov/ost/m60/grant/sincontact.htm. Additional <br />information on single audits is available from the Federal Audit Clearinghouse at <br />http://han-~ester.census.gov/sac/. <br />19. ENFORCEMENT (Reclamation 08103} <br />In accordance with 43 CFR 12.83 or 43 CFR 12.962, as applicable, if the recipient materially <br />fails to comply with any term of this agreement, whether stated in a Federal statute or <br />regulation, an assurance, in a State plan or application, a notice of award, or elsewhere, <br />Reclamation may take one or more of the following actions as appropriate: <br />19.1 Temporarily withhold cash payments pending correction of the deficiency by the <br />recipient or sub-recipient or more severe enforcement action by the awarding agency; <br />19.2 Disallow (deny both use of funds and any matching credit for) all or part of the cost <br />of the activity or action not in compliance; <br />19.3 Wholly or partly suspend or terminate the current award for the recipient's or sub- <br />recipient's program; <br />19.4 Withhold further awards for the program; or <br />19.5 Take other remedies that may be legally available. <br />20. TERMINATION (Reclamation 08/03} <br />In accordance with 43 GFR 12.84 or 43 CFR 12.961, as applicable, and except as provided for <br />in the Enforcement Provision, above, this agreement may be terminated in whole or part only as <br />follows: <br />20.1 By the awarding agency with the consent of the recipient orsub-recipient in which <br />case the #~vo parties shall agree upon the termination conditions, including the effective date . <br />and in the case of partial termination, the portion to be terminated, or <br />20.2 By the recipient or sub-recipient upon written notification to Reclamation, setting <br />forth the reasons for such termination, the effective date, and in the case of partial termination, <br />9 <br />
