This agreement shall be recorded with the Clerk and Recorder's offices in the <br />counties of Morgan and Washington, State of Colorado, and shall be binding upon the <br />parties, their respective heirs, successors, and/or assigns. <br />If Lower Platte, its successors and/or assigns, ceases to exist, the title to and interest <br />in, including the rights, duties and obligations, the pipelines and the Lower Platte <br />Well shall pass to Quint. <br />S. This agreement constitutes the entire agreement between Lower Platte and Quint <br />pertaining to the subject matter described in it and supersedes any and all prior <br />contemporaneous agreements, representations, and understanding. No supplement, <br />modification, or amendment of this agreement shall be binding unless executed in <br />writing by both parties. No waiver of any of the provisions of this agreement shall be <br />deemed or shall constitute a waiver of any other provision whether or not similar, nor <br />shall any waiver constitute a continuing waiver.
