POLICY: The Colorado ~~'ater Conser~-ation Board (C~'~"CB) may expend
funds pro~-ided under section 37-60-123.7, C.R.S. to pay for the
costs of acquiring «~ater, ~;rater rights and interests in «.~ater for
instream floe:- ("ISF') use. The primary priority for expenditures of
these funds shall be the costs of «~ater right acquisitions for
existing or ne«~ ISF «:-ater rights to preser~-e the natural
en~~ironment to a reasonable degree. These funds also maybe used
in limited circumstances for the costs of «-ater acquisitions for ISFs
to protect threatened and endangered species. support ~~-ild and
scenic alternati~~e management plans or assure federal regulatory
certainty. The CV~'CB shall appro~-e any expenditure of funds
pursuant to section 37-60-123.7, C.R.S.

The C~'~~CB ~~~ill consider recommendations from the C~VCB staff
for expenditures of funds to pav for the folio«:-ing types of costs
related to acquiring «-ater, «~ater rights and interests in ~~-ater for
ISF use:
1. lease or purchase price of «-ater, «~ater rights or
interests in «:=ater for ISF use;
2. costs of preliminary e~-aluations of the feasibility of
a temporary or permanent transfer of a ~~~ater right
for ISF use:
3. costs of historical consumpti~~e use analyses of
«.-ater rights;
4. costs of v~-ater rights appraisals:
5. costs of «~ater rights title searches: and
6. costs related to negotiating and finalizing the
agreement(s) necessary for the transaction.
PURPOSE: To establish a prioritization process for expenditures of funds
under section 37-60-123.7, C.R.S. to pay the costs of acquiring
«-ater, «-ater rights and interests in «-ater for instream flo«- use.
APPLICABILITY: This policy and procedure apply to recommendations from the
C`VCB staff to the Board for expenditures of funds to pay the costs
of acquiring «-ater, «-ater rights and interests in «~ ater for instream
flo«.- use under section 37-60-123.7, C.R.S.
