Feasibility Study <br />Kenosha Trout Club <br />Dam Modification and Augmentation Water Purchase <br />Introduction (Need for the Project) <br />The Kenosha Trout Club (KTC), located in Park County (See Figure 1), operates Lininger Ditch <br />and Lininger Lake for the benefit of the club members (lot owners) by providing water for domestic, <br />irrigation, piscatorial, wildlife and recreational uses. The ditch diverts from Beaver Creek and <br />delivers wa#er to the Lake. The KTC wishes to divert water on a continuous basis when ditch <br />freezing is not a problem to maintain the Lake level for the above uses. The ditch direct flow water <br />right and the Lake storage rights are junior priority water rights. The State Engineer's Office <br />recently started strictly administering the junior direct flow and storage water rights used to fill the <br />lake, and is requiring the KTC to acquire augmentation water to make up for evaporation losses <br />from the lake surface, or to curtail diversions during the summer months. The KTC wants to buy <br />water rights for augmentation so that the lake remains full the majority of the summertime. As a <br />part of the project, the KTC plans to make dam improvements to allow proper administration of the <br />augmentation plan, and facilitate lake operations to maintain desired water levels. The KTC <br />wishes to secure funding to rehabilitate the dam and purchase augmentation water during the year <br />2001. <br />Project Sponsor <br />The KTC is a Homeowners Association and a non-profit corporation registered in the State of <br />Colorado. Membership is required by the Covenants as a condition of property ownership within <br />the subdivision. There are 49 lots in the subdivision of which 32 are owned by the members of <br />the KTC. The balance of the fand, including the 17 unsold lots and <br />the lake are owned by the KTC. The KTC would also own the senior water rights purchased for <br />augmentation. The KTC has the power to set annual assessments to be paid by the lot owners, <br />the power to set special assessments, the power to prohibit use of the common areas (the <br />Lake) the power to file liens for unpaid dues and/or assessments, and the power to foreclose a <br />lien so created. The KTC Amended and Restated; Articles of Incorporation, By-Laws, <br />Declaration of Covenants, Conditions and Restrictions are included in Appendix A. <br />Project Service Area and Facilities <br />The KTC consists of the lot owners in the Lininger Lake Subdivision in Park County just <br />northwest of Kenosha Pass. The subdivision was platted in the 1940s, and is 100% built out <br />(primarily cabins, that is all lots not owned by the KTC have been built on.) The subdivision <br />consists of 49 lots all abutting Lininger Lake and various tracts of land amounting to <br />approximately 240 acres. Currently 32 lots are owned by members.
