Any Member may delegate, in accordance with the Bylaws and rules and regulations <br />adopted by the Board of Directors, his or her right of enjoyment to the Common Area and facilities <br />to the members of his family or contract purchasers who reside on the Property. The Board of <br />Directors shall have the express right to limit Members' ability to delegate their right to use the <br />Common Area of the Community through rules and regulations and/or reasonable fees chazged for <br />such use. <br />5.8 Restriction on Leasing. The leasing or renting of any portion of a Lot or the <br />Improvements constructed thereon is strictly prohibited. <br />5.9 Restriction on Sale of Lots. The approval of a purchaser's membership application <br />by the membership of the Kenosha Trout Club and payment of the Membership Fee shall be <br />conditions precedent to the sale of any Lot within the Club. Any Owner offering his or her Lot for <br />sale shall be required to terminate a purchase contract upon denial of the purchaser's application for <br />membership. . Each Owner agrees to foltow the procedures of the Club for transferring Lots, <br />including any forms or disclosures provided to the Owners by the Club. Every Owner agrees to <br />indemnify and hold harmless the Club from any and all claims by purchasers related to the denial <br />of an app�ication for membership if such Otivner fails to follow the procedures of the Club, including <br />failing to use forms and disclosures provided to Owner by the Club. <br />5.10 Notice to O�vners. Any Owner who decides to sell his or her Lot will give written <br />notice to the Board of Directors of Owner's intention to sell ("Notice of Intent to Sell") and may <br />provide the terms and conditions upon which the Owner ��-ishes to setl his or her Lot. Within five <br />(5) days of the Board's receipf of a Notice of Intent to Sell, the Board of Directors shall deliver to <br />all Members a copy of the Notice of Intent to Sell, at the addresses shown in the Club's records. The <br />Owner intendin� to sell his or her Lot shall not make his or her Lot available to the general public <br />until twenty-one (21) days after mailing of the notice to the Board of Directors. The Board of <br />Directors shall have the right to approve a shorter notice period if requested. <br />5.11 Rules and Regulations. In furtherance of the provisions of this Declaration, the <br />Board ofDirectors mayadopt rules and regulations concerning and governing the Community or any <br />portion thereof, including penalties for the infraction thereof, subject to notice and opportunity for <br />a hearing, subject to any requirement set forth in the Bylaws for Owner approval of the rules and <br />regulations. Breach of any rule or regulation shall be a noxious and offensive activity, constituting <br />a nuisance. <br />A.RTICLE 6 <br />INSURANCE/CONDEMNATION <br />The Club sha�l carry, if reasonably available and priced, any insurance necessary to <br />adequately cover the Community, the Common Area,�and the Board, including, but not limited to <br />liability, hazard or properly insurance, fidelity bond, directors and officers, worker's compensation, <br />and any other insurance deemed necessary or desirable by the Board of Directors.
