If a grant prmvides fumding for both construction and non-construction activities, the Grantee must obt~in written appa~oval from ]F~MA before making any fund or budget transfer from non-construction to constraxction or vice versa. B. No transfer of funds to agencies other than those identified in the approved cooperative agreement applicatimn shall be made; without prior approval from ]FEldiA. C. If a Grantee estimates that it will :have unobligated funds remainirng after the end of the performance period, the Grantee ;>hould report tllvs ~o the FEMA RegionaY Office for disposition instructions. D. Rec~uests for time ex~ensions to the. performance period will be considered but will mot be granted automatically and must b~e supported by adequate justification in order to be processed. The justi~cation shall c~~ntain the reason for the delay, a.m outline of remaining funds availalble to sa~pport the extended perf~rmance period and a description of the performance measures necessary to complete the project. Ttne othe~ termis andl conditions of this agreement are as follows: A. Prior to ~he start of any constructi~~n activity, t~e Crrantee sha11 ensure that all applflcable Federal, State, an~ llocal permits arnct clea~ances ~re obt~ined. B. Prior to the start of any project, it must be revi~wed by FEMA for compliance with the National Environmemtal Policy Act (NEPA), ~s ipnplemented under 44 CFit, Part 10. ~antees are encouraged to seek guidance from ahe FEM[A Environmental Officer in complying witln NEPA and other environmental reqirements. C. The Crrantee is free to co~pyri,ght c~rnginal work developed in the course of or under the ageement. FEMA reserves a royallty-free, nonexclusive ~nd irrevocable right to reproduce, ~publish, or otherwise use, amd to auahorize others to use, the work for Government purposes. Any publica~ion resulting from work p~rformed ~nnder this agreement shall include an acknowledgement of FEMA finarflci,al support and a statement that the pubPication does not necessari~y reflect FElV1A's views.
