No transfer of funds to agencies other than those identified in the approved cooperative <br />agreement applicatimn shall be made; without prior approval from ]FEldiA. <br />C. If a Grantee estimates that it will :have unobligated funds remainirng after the end of the <br />performance period, the Grantee ;>hould report tllvs ~o the FEMA RegionaY Office for <br />disposition instructions. <br />D. Rec~uests for time ex~ensions to the. performance period will be considered but will mot be <br />granted automatically and must b~e supported by adequate justification in order to be <br />processed. The justi~cation shall c~~ntain the reason for the delay, a.m outline of remaining <br />funds availalble to sa~pport the extended perf~rmance period and a description of the <br />performance measures necessary to complete the project. Requests for time extension will <br />not be considered unless performan~~e and financnal ~eports are current. <br />ART'~CLE Vffi - O~`HER '~'ERMS A1~Tla COlVDITIONS <br />. Ttne othe~ termis andl conditions of this agreement are as follows: <br />A. Prior to ~he start of any constructi~~n activity, t~e Crrantee sha11 ensure that all applflcable <br />Federal, State, an~ llocal permits arnct clea~ances ~re obt~ined. <br />B. Prior to the start of any project, it must be revi~wed by FEMA for compliance with the <br />National Environmemtal Policy Act (NEPA), ~s ipnplemented under 44 CFit, Part 10. <br />~antees are encouraged to seek guidance from ahe FEM[A Environmental Officer in <br />complying witln NEPA and other environmental reqirements. <br />C. The Crrantee is free to co~pyri,ght c~rnginal work developed in the course of or under the <br />ageement. FEMA reserves a royallty-free, nonexclusive ~nd irrevocable right to reproduce, <br />~publish, or otherwise use, amd to auahorize others to use, the work for Government purposes. <br />Any publica~ion resulting from work p~rformed ~nnder this agreement shall include an <br />acknowledgement of FEMA finarflci,al support and a statement that the pubPication does not <br />necessari~y reflect FElV1A's views. <br />AItT]]~[~LE IX - AUIDIT REQUlREMEr~T'S <br />Alll Grantees must ~ollow the audit requirements of OMB Ci~cular No. A-133, Revised. 1Von-Federal <br />entities that expernd $500,000 or more in F'ederal awards in a year shall have a sirngle or program- <br />specifi~ audit conducted for that year in acc;ordance with the provisions of A-133. <br />• <br />
