1 ORDINANCE N0.581 AN EMERGENCY ORDINANCE AMENDING ORDINANCE N0.579 WHEREAS, the Town of Bennett, acting by and through the Town of Bennett, Water Activity Enterprise ("Enterprise"), on February 26, 2008, approved Ordinance No. 579, entitled "AN EMERGENCY ORDINANCE APPROVING A LOAN CONTRACT BY AND BETWEEN THE STATE OF COLORADO FOR THE USE AND BENEFIT OF THE DEPARTMENT OF NATURAL RESOURCES, COLORADO WATER CONSERVATION BOARD AND THE TOWN OF BENNETT WATER ACTIVITY ENTERPRISE TO FINANCE NECESSARY WATER WELL REPLACEMENT AND AUTHORIZING EXECUTION OF THE LOAN CONTRACT;" and WHEREAS, Section 1 of Ordinance No. 579 approved such Loan Contract in an amount up to $250,000; and WHEREAS, the authorized amount under Section 1 of Ordinance No. 579 needs to be increased by $2,500 to reflect inclusion of a fee required to be paid under the Loan Contract; and WHEREAS, the Board of Trustees finds that an amendment to Ordinance No. 579 to reflect such increased amount is fair and reasonable and consistent with the form of Loan Contract approved by Ordinance No. 579; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF BENNETT, COLORADO ACTING BY AND THROUGH THE TOWN OF BENNETT, COLORADO WATER ACTIVITY ENTERPRISE: Section 1. Section 1 of Ordinance No. 579 is hereby amended to increase the loan amount stated therein from $250,000 to $252,500. Such Ordinance, as herein amended, is hereby ratified and confirmed. Section 2. All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. Section 3. The Board of Trustees herewith fmds, determines and declares that this ordinance is necessary for the immediate preservation of the public health and safety in order to timely effectuate the provisions hereof so as to timely implement necessary improvements to the waterworks system of the Town, and this ordinance shall take effect upon adoption, provided the same has been adopted and signed by the Mayor or Mayor Pro Tem and approved bythree-fourths of the entire Board of Trustees.
