RESOLUTION NO.
A RESOLUTION APPROVING THE PETITION FOR THE
CREATION OF THE YUMA COUNTY WATER
AUTHORITY PUBLIC IMPROVEMENT DISTRICT; AND
PROVIDING OTHER DETAILS RELATING THERETO
WHEREAS, on July _, 2008, a petition (the "Petition") for the organization of
the Yuma County Water Authority Public Improvement District, in Yuma County, Colorado (the
"Proposed District"), which Petition is attached hereto and incorporated herein as Exhibit A, was
filed in the office of the Clerk to the Board of County Commissioners of Yuma County (the
"Clerk"); and
WHEREAS, on August 11, 2008, the Board of County Commissioners (the
"Board") adopted a resolution fixing a place and time for a hearing on the Petition, the date of
said hearing being August 29, 2008; and
WHEREAS, the Clerk has caused notice by publication to be made of the
pendency of the Petition, including the purposes and boundaries of the Proposed District, and of
the time and place of the hearing thereon, such notice having been published in the Yuma
Pioneer and the Wray Gazette, newspapers of general circulation in the Proposed District, for the
time and in the manner required by law; and
WHEREAS, the Clerk also caused a copy of such notice to be mailed to each
elector of the Proposed District at the elector's last known address, as disclosed by the tax
records of the County and the last official voter registration lists, and caused a copy of such
notice to be mailed to each municipality located within three miles of the boundaries of the
Proposed District at the same time notice was mailed to the electors; and
WHEREAS, at the time and place specified in such notice, the Board held a
public hearing on the Petition, at which hearing all persons wishing to do so were given an
opportunity to be heard; and
WHEREAS, the Board ascertained from the tax rolls of the County, from the last
official voter registration list, and from such other evidence as may have been adduced at the
hearing, the total number of electors of the Proposed District, and has adjudicated all questions
of jurisdiction;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF YUMA COUNTY, COLORADO THAT:
Section 1. FindinES and Determinations. The Board hereby accepts the
Petition for the Organization of a Public Improvement District in the County of Yuma, Colorado,
which requests the formation of a public improvement district to be known as "Yuma County
Water Authority Public Improvement District". The Board hereby finds and determines that:
