COLOAADO WATER CONSERVATION BOARD

This is a notice of a public rulemaking hearing before the Colorado Water Conservation
Board (CWeB) for consideration of an amendment to the Rules Concerning the Colorado
Instream Flow and Natural Lake Level Program, 2 CCR 408-2'.. The amendment implements
H.B. 05-1039, which amends Section 37...83..105, C.R.S., the statute that authorizes the eWeB to
temporarily acquire water rights for instream flow use under certain conditions and in accordance
with specified procedures. The proposed amendment is set forth below.. A redlined version of
the proposed rule showing changes to the current rule is posted on the CWCB's website at
httD:Jlwww/cwcb. state. co. us. A hard copy is available upon request to the CWCB staff (1313
Sherman Street. Room 723, Denver, CO 80203; (303) 8~3S34). The CWCB may change the
proposed amendment as. set forth herein prior to or at the rolemaking hearing. The eweB will
consider any alternative. proposals related to the proposed amendment.

presentations of the information contained in the written comments will not be necessary;
however, the eWeB will allow brief oral summaries of the public written comments to be made,
to the extent time allows, as described below. Although the CWCB strongly encourages all
interested persons to submit their comments in writing, a short period of time at the end of the
