Page 3 <br />7. Application of CWCB on Fall River, 95CW256 <br />On October 15, 2007 the Court entered the proposed decree submitted by the CWCB. Following <br />stipulations with Central City and Agricultural Ditch and Reservoir Company in July, the CWCB <br />worked with Central City to revise the location of the downstream terminus of the ISF. Pursuant <br />to the Stipulation between the CWCB and Central City, the ISF reach was shortened <br />approximately 300 feet to terminate at Central City's pipeline diversion point. <br />DEFENSE OF THE COLORADO RIVER SUBUNIT <br />Legal Counsel with respect to Colorado River Negotiations and NEPA process <br />8. 7-State Proposal and NEPA Process <br />The State of Colorado has been actively involved in negotiations with the seven Colorado River <br />Basin States ("7-States") in effort to coordinate with the Bureau of Reclamation on the NEPA <br />process for management of the Colorado River System under low supply and storage condition. <br />In April, the 7-States finalized Proposed Guidelines and an Agreement (collectively "7-State <br />Proposal") that asks the Secretary to adopt the guidelines to be issued in a record of decision <br />later this year. The 7-States also submitted separate comments to the Bureau on the Draft <br />Environmental Impact Statement that convey the importance of protecting their respective <br />interests on the Colorado River. In June, the Bureau announced the preferred alternative, based <br />in large part on the 7-States' Proposal, and sought input from the 7-States on finalizing and <br />publishing the Final Environmental Impact Statement by November 9, 2007. Following <br />announcement of the preferred alternative, a disagreement developed among the 7-States <br />concerning reservoir equalization operations as described in the Proposed Guidelines. Since that <br />time, the States have been working diligently among themselves and with the Bureau to rectify <br />this disagreement so an acceptable environmental impact statement and record of decision can be <br />finalized by the end of the year. <br />The Colorado River Subunit has provided the Colorado Water Conservation Board, Governor's <br />Representative, and the Upper Colorado River Commission with legal counsel during both the 7- <br />Statesnegotiations and the Bureau of Reclamation's NEPA process. In addition, the Subunit has <br />drafted correspondence and memorandum on behalf of Colorado and the Upper Division States <br />that preserve our positions concerning equalization operations of the Colorado River's reservoir <br />system. The Subunit will continue to provide this assistance and legal counsel until the Secretary <br />of the Interior issues a record of decision that substantially complies with the 7-States Proposed <br />Guidelines and Agreement as interpreted by the State of Colorado and the rest of the Colorado <br />River Basin States. <br />9. Mexico Shorta e Sharin <br />The Colorado River Subunit currently provides the Colorado Water Conservation Board and <br />Governor's Representative legal counsel on whether and how Mexico should share in shortages <br />of the Colorado River System.
