Consent Agenda Item 1.c <br />Case No. 4-08CW081: Application of U.S. Energy Corporation <br />Application Summary <br />This is an application for finding of reasonable diligence concerning certain conditional water <br />rights in Gunnison County near Crested Butte. The Applicant seeks, among other claims, <br />storage right for Carbon Creek Reservoir to be constructed as an on-channel reservoir on Carbon <br />Creek. The capacity of Carbon Creek Reservoir will be 1000 acre-feet with a November 11, <br />1996 appropriation date. The dam's height and length will be 115 ft and 990 ft, respectively. <br />CWCB Appropriation <br />The C~UCB holds the following instream flow water rights that could be injured by this <br />application: <br />CWCB StreamlLake Amount Approp. Watershed Coun <br />~ <br />Case No. cfs Date <br />80CW109 Carbon Creek 3 3/17/80 Upper Gunnison Gunnison <br />Potential for Injury <br />Applicant's proposed on-channel reservoir will inundate a portion of the Board's instream flow <br />reach on Carbon Creek. <br />Other Objectors <br />Statements of Opposition were also filed by the City of Gunnison, Trappers Crossing at Crested <br />Butte Association, Inc., Star Mountain Ranch Association, Inc., Crested Butte Land and Trust, <br />High Country Citizens' Alliance, and the U.S. Department of Justice. <br />
