Authority exists in the law, and funds have been budgeted, appropriated and <br />otherwise made available and a sufficient unencumbered balance thereof remains <br />available for payment in Fund Number 424, Organization YYYY, Appropriation Code <br />FSL, GBL G788, Program WTRC, Object Code 5120, Reporting Category 3788, <br />Contract Encumbrance Number C153788. <br />B. Required approval, clearance, and~~ have been accomplished from and <br />with appropriate agencies. <br />c. Pursuan# to the provisions o 7- -60-122(1)(c), C.R.S. (1990 and <br />Supp. 1996), the STATE is au o ze o e for the construction of certain <br />water projects for the benefit of the people of t e ate of Colorado, and to expend <br />moneys for feasibility studies on such projects, provided that the borrower assures <br />repayment of that money. <br />o. The BORROWER is a duly constituted Colorado non-profit corporation located in Weld <br />County, Colorado. <br />E. The BORROWER has applied to the STATE for a loan to conduct a feasibility study <br />(hereinafter referred to as STUDY) to conduct a detailed evaluation of the BORROWER'S <br />water storage and distribution system and select a financially sound alternative to <br />rehabilitate the BORROWER'S irrigation system (hereinafter referred to as PROJECT), at <br />an estimated total cost of approximately $66,773. <br />F. At its January 29-30, 1997 meeting, the CWCB approved a loan to the BORROWER in <br />an amount not to exceed $23,400 at an interest rate of 3.25% per annum and for a <br />term of 10 years to finance the costs of the STUDY. <br />G. The STATE now desires, by this contract, to loan money to the BORROWER for this <br />STUDY upon mutually agreeable terms and conditions. <br />Feasibility Report Loan Contract Page 1 of 11 <br />
