Page 6 <br />- Continued_to provide legal counsel to CWCB regarding whether and how Mexico should <br />share in shortages of the Colorado River System. The Subunit is in the process of <br />reviewing and commenting on documents prepared by the IBWC and Core US Group <br />that would develop a formal process for identifying and pursuing water projects for the <br />joint benefit of US and Mexico stakeholders in the region. <br />- Continued preparation of the Colorado River Compact Database, including scanning, coding <br />and organizing the State's Colorado River documents so as to assist in any future Colorado <br />River litigation. <br />17. Grand Canyon Trust v. Bureau of Reclamation <br />The seven Basin States (Arizona, California, Colorado, Nevada, New Mexico, Utah and <br />Wyoming) and the Southern Nevada Water Authority filed a Joint Motion to Intervene in this <br />litigation on May 2, 2008. On June 3, 2008, the Federal District Court for the District of <br />Arizona granted our Motion to Intervene. The Basin States filed an Answer to the <br />Supplemental Complaint filed by Grand Canyon Trust on June 16, 2008. The Federal <br />Defendants also filed an answer on that date, but did not include a Motion to Dismiss the <br />new claims set forth in the Supplemental Complaint. The presiding judge set an oral <br />argument for the claims fully briefed to date for August 29, 2008 in the Federal District <br />Court in Phoenix. This oral argument will only address the first five claims set out by Grand <br />Canyon Trust, but will not address the new claims added via the Supplemental Complaint. <br />The Basin States, working in conjunction with the other two Intervenor groups in this <br />litigation, have developed talking points which the Federal Defendants will incorporate into • <br />their oral argument on August 29, 2008. At this time, it appears that all seven Basin States <br />will send a representative to the oral argument in Phoenix. As coordinating counsel for the <br />Basin States, the subunit will be present. <br />• <br />
