~~ction: CWCB staff recommends that in the event that staff is unable to draft a Goodman Point
Phase II Project loan document that would likely make it through the state system, then
the Board authorizes staff to provide the full $240,000 for the project in the form of a
grant. A motion was made by Don Schwindt and seconded by Carl "Prick to approve
staff recommendation. "l~he motion was approved unanimously (9-0).
27. Stream and I_akr Protection Section Rob Billerbeck of Colorado State Parks gave a presentation
on aquatic nuisance species in Colorado and the Colorado Aquatic Nuisance Species Steering
Committee's statewide planning efforts to protect the state's waters from these invasive species.
Ile also provided an update on how the state is addressing the discovery of zebra mussels in
Pueblo Reservoir.

comment on 19 ISI~ appropriations pursuant to ISF Rule Sc. 'I'hc Board declared its intent to
appropriate in January 2008.

30. Stream and Lake Protection Section -Injury with Mitigation ('ase No. 3-99CW34; Application
of Charles E. Nearburg

Action: A motion was made by Carl 'trick and seconded by Barbara Biggs to approve statt~
recommendation that the Board determine that the natural environment of'frout Creek
could be preserved to a reasonable degree with the proposed injury if Charles Nearburg
provides the proposed mitigation, and authorize staff and the Attorney General's Office
to enter into a stipulation with Charles Nearburg implementing the injury with mitigation
proposal as approved by the Board that also includes terms and conditions that are ILlly
protective of the Board's instream flow water rights related to the other aspects of this
water court application. 'The motion was approved unanimously (9-0).
