The authorizing legislation directed the CWCB to work in consultation with the basin water <br />users in developing the program "design". The criteria and guidelines were developed jointly by <br />many of the applicants and focus on advancing beyond academic/scientific concepts to applied <br />strategies to establish rural-urban partnerships that provide reliable water supplies while <br />sustaining rural communities. The criteria and guidelines were adopted by the CWCB at their <br />January 2008 meeting and are attached. <br />Super Ditch Compan~ <br />At the May 21, 2008 CWCB meeting, the Board approved funding of the LAVWCD Super Ditch <br />Company project in the amount of $320,000. This is a reduced amount compared to the <br />applicant's grant request of $480,371. The Board approved the Super Ditch Company <br />application contingent upon several conditions. One of those conditions was for the applicant to <br />conduct a legal analysis involving antitrust issues described in the scope of work and a legal <br />analysis of how their project protects property and water rights for Super Ditch participants and <br />non-participants and for the applicant to present this analysis to the CWCB for their <br />consideration and approval. The applicant will present this analysis to the Board during this <br />. <br />agen a item. <br />Subsequent to the May 2008 CWCB meeting, staff has met with the applicants to discuss the <br />approval and Board action. The applicant proposes to modify the project's scope of work to <br />account for the shortfall in funding of approXimately $160,000. The original scope of work <br />included the following tasks: <br />Tasks Budget <br />A-C: Engineering and Economics $334,210 <br />D: Water Quality $122,496 <br />E: Anti-trust Analysis $17,500 <br />F: Corn Fallowing $19,540 <br />G: Comprehensive Report $40,000 <br /> <br />Total Project Costs $533,746 <br />Match $53,375 <br />Ori inal Grant Re uest ~480,371 <br />The applicant proposes to remove tasks related to the proj ect's effects on water quality and the <br />effects on the soil from rotational fallowing and potentially return at the November 2008 CWCB <br />meeting to request funding of these tasks. Also, since the applicant has performed the anti-trust <br />analysis prior to approval, this task is removed from the scope of work.
