Consent Agenda Item l .a
Case No. l -08CW074: Application of Westcreek Lakes Water District
Application Summary
This is an application for change of water rights in Douglas County near the Town of Deckers. The
Applicant seeks new points of diversion for Well Nos. l through 4 for groundwater tributary to West
Creek. The Application states that, "These changes are needed, in part, due to silt deposited over
well heads caused by the flood following the Hayman fire." The decree in Case No. 74W7684,
entered on 2/14/1977, confirmed these water rights for municipal and domestic purposes.
Notes:
The new points of withdrawal for Wells 1 & 2 are downstream of the original points but the new
points of withdrawal for Wells 3 & 4 are upstream of the original points by approximately % mile
each. The Application does not desci^ibe the soup^ces of augmentation or methods of replacing
depletions. The original wells were decreed prior to instrea~n flow appropriations and are,
therefore, senior to instream flow water i^ights. However, a reach of the West Ci°eek insti°eam flow
may be impacted by the entire diversion and not just the depletions. Also, the delayed impacts from
the pumping wells at their new locations may be different than those occur°J^ed historically.
CWCB Appropriation
The CWCB holds the following instream flow water rights that could be injured by this application:
CWCB
Case No. Stream/Lake Amount
cfs Approp.
Date Watershed County
1-80CW211 West Creek 4 5/7/80 Upper South Platte Douglas
1-80CW210 Horse Creels 5 5/7/80 Upper South Platte Douglas
Potential for Injury
The Applicant's proposed change of points of withdrawal for its wells may cause injury to the
instream flow water rights on West Creek and Horse Creek by not replacing depletions in time,
amount an ocatlon.
Other Objectors
No other Statements of Opposition to this application were filed.
