Would like comments from Fred Walker. <br />5:00 Results of Supreme Court Committee on Water Court Reform: Mike Shimmin <br />Summary is on Supreme Court website. <br />Idea of context within which this is happening: See CO Lawyer: Chief Justice of <br />Supreme Court has just issued a new directive to all courts establishing goals and <br />benchmarks for case management in all of trial courts both ... and district... thus <br />timely processing of water cases is happening in context of all cases within the <br />state, thus, idea that water court is being a focal... Supreme Court is reviewing <br />case management targets for all cases: <br />Directive: These are not mandatory requirements but rather goals and objectives <br />for trial courts to meet: civil cases: no more than 10% should be open for more <br />than 1 year: benchmark for individual judges: no more than 20% should be open <br />for 18 months, thus if you think of this in water court timing, you can consider <br />that the Supreme Ct in past has not focused on how water courts work: this is the <br />first time that focus has been on working within supreme ct. <br />--Written report on website: 10 different recommendations from committee to <br />Supreme Court: <br />1) Gen assembly should consider amendments to move White River from <br />Division 5 to Division 6, in State engineers office, this is already part of Division <br />6... but in court..Part of 5 ... so fix, and move it, interim water resources will <br />consider this (now with CO but move them to Yampa) combined of course in <br />Basin service; this will be lease <br />2) Supreme Court should amend Rules of Procedure 90 and 2, 3, 6, 11 to revise <br />Nyay that water court cases get processed, Supreme Ct is in charge of and adopts <br />Rule of Civil Procedure for all courts and for all water courts, they will go <br />through formal rules making process... this has not yet begun. <br />3) SCT should adopt a declaration for all water experts to sign: debate in <br />academic circles about whether experts are biased and more adversarial than they <br />should be, this is an attempt to respond to that perception, sign a declaration that <br />thev understand that they- are advisors of the court.
