Consent Agenda Item l .b <br />Case No. 5-08CW077: Application of Eagle River Water and Sanitation District <br />Application Summary <br />This is an application for a conditional surface water right and approval of a plan for <br />augmentation for the Eagle River Water and Sanitation District in Eagle County. The Applicant <br />seeks to adjudicate a seven cfs conditional water right for the Eagle River Water and Sanitation <br />District's Wolcott Municipal Diversion for various uses. The Applicant seeks to divert said water <br />from five alternate points of diversion. The Applicant also seeks approval of a plan to augment <br />out-of priority depletions up to a maximum of 580 consumptive acre feet per year. The amounts <br />and sources of replacement water are: up to 330 AF from Eagle Park Reservoir and up to 250 AF <br />from Homestake Reservoir. <br />CWCB Appropriation <br />The CWCB holds the following instream flow water rights that could be injured by this <br />application: <br />CWCB StreamlLake Amount Approp. Watershed Coun <br />~ <br />Case No. cfs Date <br />5-80CW126 Eagle River 110/45 3/17/80 Eagle River Eagle <br />5-80CW124 Eagle River 130/50 3/17/80 Eagle River Eagle <br />Potential for Injury <br />The Applicant's proposed plan for augmentation may injure the Board's instream flow water <br />rights on the Eagle River by not replacing depletions in time, amount and location. <br />Other Objectors <br />Grand Valley Water Users Association, Orchard Mesa Irrigation District, Ute Water <br />Conservancy District, acting by and through the Ute Water Activity Enterprise, the City of <br />Aurora, and the State and Division Engineers also filed Statement of Oppositions to this <br />application. <br />
