CO <br /> <br />Deed of Trust <br /> <br />October 27, 2006 <br />LINCOLN PARK CROOKED DITCH COMPANY <br />eOLORADO WATER eONSERVATION BOARD <br />FREMONT <br />$1,818,000 <br />Loan Contract No. C150230, dated October 27,2006 <br />3.25% per annum for 30 years <br />An undivided one-hundred percent interest in the GRANTOR'S <br />ditch system, including its headgate, located in Fremont eounty, <br />eolorado, including all easements, rights-of-way, measuring <br />boxes, valves, flumes, and other irrigation works, appliances, <br />equipment and machinery associated with the ditch and <br />headgate. <br /> <br />Also, an undivided one-hundred percent interest in the following <br />described water rights: (1) 2.0 cfs decreed to the Lincoln Park <br />Crooked Ditch Company, diverted from the Arkansas River and <br />carried through the South Canon Ditch for irrigation of various <br />lands, with an appropriation date of May 1, 1862; (2) 3.0 cfs <br />decreed to the Lincoln Park Pump Ditch eompany, diverted from <br />the Arkansas River and carried through the South eanon Ditch for <br />domestic use, with an appropriation date of February 28, 1866; (3) <br />3.0 cfs decreed to the Lincoln Park Crooked Ditch Company, <br />diverted from the Arkansas River via West Creek and carried <br />through the South Canon Ditch and West ereek, with an <br />appropriation date of June 1, 1904 for irrigation of various lands. <br /> <br />Also, an undivided one-hundred percent interest in Lincoln Park <br />Crooked Ditch Company's ownership or conveyance interest in the <br />South Canon Ditch, as may exist in conjunction with the above <br />decrees. <br /> <br />This indenture is between the Grantor, and the Public Trustee of the above referenced <br />COUNTY, State of eolorado ("PUBLIC TRUSTEE"), <br /> <br />FACTUAL RECITALS <br /> <br />1. The GRANTOR has executed a Promissory Note of even date and amount, set forth in the <br />LOAN eONTRACT, for a loan in the PRINCIPAL LOAN AMOUNT to be repaid to the BENEFICIARY, <br />with TERMS OF REPAYMENT and in accordance with the Promissory Note or until loan is paid <br />in full. <br /> <br />2.
