<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />FEASIBILITY STUDY <br />FOR THE REHABILITATION and ENLARGEMENT OF <br />BULL CREEK RESERVOIRS NOS. 1, 2 AND 4 <br /> <br />INTRODUCTION and NEED FOR PROJECT <br /> <br />The Bull Creek Reservoir, Canal and Power Company ("Reservoir Company"), located in Mesa <br />County, Colorado, operates Bull Creek Reservoirs Nos. 1-5 to provide irrigation water for farmlands <br />in the Plateau Valley area of Western Colorado. The Reservoir Company is organized as a <br />Colorado non-profit corporation 1 which has been in existence for nearly 100 years. <br /> <br />Irrigation water stored in the Reservoir Company's reservoirs is released by the Reservoir <br />Company into Bull Creek and delivered downstream to various points of diversion for irrigation of <br />approximately 800 acres of farmland. Water from the reservoirs is the primary source of summer <br />and late season irrigation water. Without this water crops would be water short in most years. The <br />location of the project is shown on Figure 1, page 2. <br /> <br />The reservoirs are in need of rehabilitation or/and enlargement for the following reasons: <br />1 ) A filling restriction imposed by the State Engineers Office has in turn <br />resulted in a filing by the Division Engineer for partial abandonment of senior <br />water rights (Bull Creek Reservoir No.4). <br />2) The Division Engineer via the 2001 filing for decennial abandonment has <br />claimed less storage exists than was decreed absolute for Bull Creek <br />Reservoirs Nos. 1 and 2. Inaction will result in the loss of valuable senior <br />water rights. <br />3) A judgement of the Division Dam Safety Inspector that instability of the <br />embankment might be occurring (Bull Creek Reservoir No.4). While <br />instability has not been proven or disproven, it is logical to upgrade the <br />facility to current design standards while restoring active storage that has <br />been previously decreed absolute, and will be lost to abandonment if no <br />action is taken. <br /> <br />1 See Appendix A for the Articles of Incorporation and Bylaws of the Company <br /> <br />Bull Creek Reservoir, Canal and Power Company <br />Bull Creek Reservoirs Nos. 1,2 and 4, Feasibility Study <br />May 31, 2004 <br /> <br />Page 1 of 12 <br />
