<br />WHEREAS, pursuant to the provisions of section 37-60-1l9,
<br />Colorado Revised Statlltes, as amend~d, the State is authorized
<br />to construct cer~ain water projects for the benefit of the
<br />people of the State of Colorado; and
<br />
<br />WHEREAS. the Farmers wat~~,l[lkJbent Company has made
<br />application to the State for ~~provement of its existing
<br />facility. such improvement,~\~" TfflillY, ,is hereina:::.er

<br />WHEREAS. the Contractor is a water development company
<br />within the State of COlorado;
<br />
<br />NOW THEREFORE, it is hereby agre~d that:
<br />
<br />1. ~he Contractor shall have a feasibility report prepared
<br />and directed to the prOblem of improving the facility of the
<br />Contractor (Gurley Rese.::voir) in accordance with a p.::oposal for
<br />a project feasibility report prepared by tne consulting
<br />engineering firm 0: Ste:fen Robertson and Kirsten (the
<br />Consultant) and approved by the State, received Februa.::y 10,
<br />1987, which proposal is attached hereto as Exhibit A and made a
<br />part of this cont.::act.
<br />
<br />2. Fifteen (15) copies of the final report called for in
<br />this contract shall be furnished to the State not later than
<br />May 3D, 1987. unless such time is extended by mutual a~reemen:
<br />of the partie~ hereto in writing.
<br />
<br />3. As compensation for the services of the Contractor, the
<br />State shall pay to the Contractor the sum of Sixty Thousand
<br />Dollars ($60.000) in the manner following:
<br />
<br />a. Sixty percent (60%). to wit. Thirty-Six Thousand Dollars
<br />($36,000) of the total amount due in two (2) monthly
<br />installments of Eighteen Thousand Dollars ($18,000) each,
<br />commencing on March 1, 1987.
<br />
<br />b. :'he remaining forty percent (40\.), to wit. :'wenty-Four
<br />Thousand Dollars ($24,000) within forty (40) days following
<br />receipt and acceptance of ~he written report .specified in
<br />paragraph 2. of this contract.
<br />
<br />4. :'he total cost of services to be rendered [or the
<br />Contractor by the Consultant is Eighty-Five Thousand Dollars
<br />($85,000) and the Contractor shall pay the sum of Twenty-Five
<br />Thousand Dollars ($25,000), and in no event shall this payment
<br />be the liability of the Stale of Colorado.
