Contract Encumbrance Number C153406; and <br />ABL Account Number 14040, Org. Unit 77-77-777, <br /> <br />WHEREAS. rC4uired approval. clearance and coordination has been accomplished from and with appropriate <br />agencies: and <br /> <br />~HEREAS, the State and the Contractor did, on July 1, <br />1983, enter into a contract for State participation in the <br />enlargement and improvement of the Hertha Reservoir for the <br />ditch company members in Larimer County, which contract is <br />attached hereto as Exhibit A and is hereby incorporated herein; <br />and <br /> <br />WHEREAS, the construction bid received, together with the <br />change orders necessary to complete the project, exceeded the <br />engineers' estimate; and <br /> <br />WHEREAS, douse Bill 1102 (1983 Session), which authorized <br />the Hertha Reservoir also provided. t~.at the Bo~a, :rcould expend <br />ot;l the proj ect spec i ~ ied the amo~!S1P~\tnQ~'( t"" . ~tked pI us or <br />IUlnus such amounts, lf any, as mail.bE:l_Jiuli8Il~d ryy reason of <br />ordinary fluctuation in construction costs as indicated by the <br />engineering cost indices applicable gp~y~~s of <br />construction involved for such projeUJ.~'t60ay be justified <br />by reason of changes made in the plans and specifications of <br />the project if those changes are required by finalized <br />engineering drawings and specifications; and <br /> <br />WHEREAS, the State is satisfied that up to four percent <br />(4%) of increase in construction costs has occurred from the <br />ti~e the project was authorized until the project was bid; and <br /> <br />WHEREAS, by reason of changes made in the plans and <br />specifications, the project cost has increased from the amounts <br />estimated by the en'gineers at the feasibility study level; and <br /> <br />NOW THEREFORE, in consideration of the mutual and dependent <br />convenants herein contained, it is agreed by the parties hereto <br />as follows: <br /> <br />1. The terms and provisions of paragraphs A12, Cl and I <br />of that certain contract dated July 1, 1983, attached hereto as <br />Exhibit A and incorporated herein by reference, shall no longer <br />be effective. All other terms and provisions of that certain <br />contract dated July 1, 1983, shall remain in full force <br />and effect. <br /> <br />2.
