Describe hoiv the water activity- meets these Threshold Criteria. <br />The water activity meets the eligibility requirements outlined in Part 2 of the Criteria <br />and Guidelines. <br />The proposal meets the eligibility requirements as the applicant is a governmental <br />agency (municipality) and the proposal is for both nonstructural and structural Nvater <br />activities. The proposal is in line with several of the SWSI findings particularly: <br />4. Supplies are not necessarily where demands are; localized shortages exist, <br />especially in headwater areas, and compact entitlements in some basins are not <br />fully utilized. <br />9. The ability of smaller, rural water providers and agricultural water users to <br />adequately address their existing and future water needs is significantly, affected by <br />their financial abilities. <br />The Tosvn of Yampa lies near the headwaters of the Yampa River Basin and. as a <br />small municipality, lacks sufficient funding to develop its water supplies and <br />infrastructure without financial aid. This proposal also addresses a key SWSI <br />recommendation: <br />6 Develop implementation plans towards meeting fixture water supply needs <br />both for identified projects and processes and in areas where there are no <br />identified plans to meet fixture needs. <br />Although this project ivas not directly identified by SWSI, it is addressing municipal <br />water needs. These needs have been identified for over 25 years by the proponent. <br />CWCB guidance states "0 there is a need to help expedite the implementation of <br />water management projects for all water needs; ... 3) there is strong desire for the <br />state to provide financial assistance. " This proposal is in line Avith the stated <br />guidance. <br />2. The water activity is consistent with Section 37-75-102 Colorado Revised Statutes. <br />The requirements/language from the statute is provided in Part 3 of the Criteria and <br />Guidelines. <br />This proposal is intended, in part, to evaluate the Nvater rights of the Town of Yampa <br />and insure their physical and legal status for current and future water needs. The <br />proposal is consistent with Section 37-75-102 CRS. <br />The water activity underNvent an evaluation and approval process and Nvas approved <br />by the Basin Roundtable (BRT) and the application includes a description of the <br />results of the BRTs evaluation and approval of the activity. At a minimum, the <br />description must include the level of agreement reached by the roundtable, including <br />any minority opinion(s) if there was not general agreement for the activity. The <br />description must also include reasons why general agreement was not reached (if it <br />was not), including who opposed the activity and why they opposed it. Note- If this
