Gimbel <br />CWCB Director <br />RE: Request for Administration of Instream Flow Rights on Fish Dan McAuliffe <br />Creek CWCB Deputy Director <br />DATE: August 25, 2008 <br />On behalf of the Colorado Water Conservation Board, I hereby request the water officials of the <br />State of Colorado to administer the following Instream flow water rights on Fish Creek in accordance <br />with the priority system. All of these water rights are decreed to the reach of Fish Creek extending from <br />the Mt. Werner Pipeline to the confluence with the Yampa River to preserve the natural environment to a <br />reasonable degree. <br />Case No. 79CW104A - 2 cfs -Appropriation date: 3/14/1979 <br />The following are water rights that were acquired by the CWCB and changed to Instream flow use: <br />Case No. 76W959F (Hoyle and Knight) - 2 cfs - Appropriation date: 5/14/1910 <br />Case No. 76W959G (Hoyle and Knight) - 1 cfs - Appropriation date: 10/01/1927 <br />Case No. 76W959H (Hoyle and Knight) 1 cfs Appropriation date: 5/01/1942 <br />Case No. 76W591 (Park City #2) -- 1 cfs - Appropriation date: 7/4/1963 <br />Case No. 76W959J (Welch and Waters) - 2.1 cfs -Appropriation date: 8/01/1944 <br />The Board is hereby placing a written call for the above-described Fish Creek Instream flow water rights <br />to ensure that the full decreed amount of this water right is made available for the decreed beneficial use <br />of preserving the natural environment to a reasonable degree. <br />The effective date of this call is August 25, 2008, and the call is to be in effect until further written notice <br />from the Board to you. <br />Signed: Isl <br />Print Name: Linda J.
