ISF Rule 8i.(3) -Injury With Mitigation May 20, 2008 ISF Rules Workshop <br />situations, the Board may consider additional factors in <br />specific cases. Further, evaluation of each injures <br />miti atg ion proposal will require the exercise of professional <br />jud ment re a~ rdin~ the specific facts of the proposal. <br />i Extent of the proposed injury <br />(a) Location of injury -affected stream(s) and len t,~ h of <br />affected reach(es~ <br />(b) Amount, timin and frequency of shortage(s) to the <br />affected ISF water right(s) <br />(c) Potential impact to the natural environment of the <br />affected stream reach from such shortages <br />11. Benefits of the mitigation to the natural <br />environment <br />(a) The nature and extent of the benefits the miti anon will <br />provide to the existing natural environment of the <br />._ <br />affected stream <br />(b) The scientific justification for acceptin the miti a,~ tion <br />(c) Whether the mitigation will enable the Board to <br />~, .. <br />continue to preserve or improve the natural <br />environment of the subject stream to a reasonable <br />d <br />iii. Evaluation of proposed alternatives. This <br />evaluation applies both to alternatives explored to <br />provide full protection of the potentially affected <br />ISF water right, and to mitigation alternatives. <br />(a) Availability of on-site mitigation alternatives <br />._ <br />(b) Technical feasibility of each alternative <br />~, <br />(c) Environmental benefits and consequences of each <br />alternative <br />(d) Economic benefits and consequences of each <br />alternative <br />(e) Reasonableness of alternatives <br />~, <br />(h) The Board will consider off site mitigation as a last resort <br />._ <br />and only will consider mitigation in an area other than the <br />.. <br />affected stream reach if no reasonable alternative exists for <br />mitigation on the affected stream reach.
