Gimbel <br /> <br />Stream and Lake Protection Section CWCB Director <br /> Dan McAuliffe <br />DATE: Ma 12 2008 <br />y cwcB ~epUty Director <br />SUBJECT: Agenda Item 13, May 20-21, 2008 Board Meeting <br />Stream and Lake Protection -Uncontested 2008 Instream Flow <br />Appropriations. <br />Summary <br />At its January 23, 2008, meeting, the CWCB formed its intent to appropriate Instream flow water <br />rights on 19 new stream segments in water divisions 1, 2, 5 and 6. All 19 segments were <br />uncontested and are ready for final Board action pursuant to ISF Rule Sh. <br />Staff requests that for each appropriation, the Board make the required determinations pursuant <br />to Rule Si, set an appropriation date of January 23, 2008, and direct staff to request the Attorney <br />General's Office to file the necessary water rights applications. <br />Discussion <br />On January 23, 2008, the CWCB formed its intent to appropriate Instream flow water rights on <br />the 19 stream segments listed in the table below. The Bureau of Land Management (BLM), <br />Colorado Division of Wildlife (CDOW) and/or Trout Unlimited (TU) recommended these <br />streams for inclusion into the CWCB's Instream Flow Program and Natural Lake Level Program. <br />Pursuant to Rule 5h. of the Instream Flow and Natural Lake Level Rules ("ISF Rules"}, these <br />stream segments are being recommended to the Board for Final Action. The segments have been <br />noticed pursuant to the ISF Rules and the public was afforded an opportunity to comment <br />pursuant to Rule Sg. at the March 2008, CWCB meeting. All 19 of the proposed Instream flow <br />appropriations are uncontested.
