Legal description of the stream segment through which an instream flow is claimed <br /> <br />a. The natural stream channel from the confluence of Sheep Creek at <br />latitude 380 14' 28" N and longitude 1080 14' 38" W as the upstream <br />terminus and extending to the confluence of the San Miguel River at <br />latitude 380 12' 19" N and longitude 1080 18' 46" W as the <br />downstream terminus, being a distance of approximately 5.2 miles. <br />This segment can be located on the Norwood and Sanbom Park <br />u.s.a.s. quadrangles. <br /> <br />b. Use of the water: <br />To preserve the water dependent natural environment of Horsefly Creek to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: January 25,2005. <br /> <br />7. The water was first applied to the above beneficial use on January 25, 2005, <br />by the action of the Colorado Water Conservation Board under the provisions of C,R.S. <br />S S 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 13.0 cf.~ (April 1 <br />through June 5). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 13.0 cfs <br />(April I through June 5) is hereby entered to preserve the natural environment to a <br />reasonable degree through the stream segment described in paragraph 4 above.
