For the stream segments in an unsurveyed area, the Division Engineer has determined
for administrative purposes that the approximate legal description of the instream flow
tennini as protracted from U.S.G.S. and/or U.S.F.S. mapping is as follows: upstream
tenninus in the SE SE, S23, T47N, RI2E, N.M.P.M., 800 feet from the South section
line and 750 feet from the East section line; downstream terminus in the SE SW, S7,
T19S, R73W, 6th P.M., 1000 feet from the South section line and 2700 feet from the
East section line.

Instream flow to preserve the natural environment to a reasonable degree.

II. Date of initiation of appropriation:

January 29,1998.

12. The water was first applied to the above beneficial use on January 29, 1998, by action
of the Colorado Water Conservation Board under the provision of C.R.S. ~~ 37-92-102(3),
37-92-103(3), (4), (10).

13. Amount of water claimed (ABSOLUTE): Instream flow of7.75 c.f.s. (May I-October
31); 3.50 c.f.s. (November I-April 30).

THE COURT HEREBY DECREES:

Based upon and fully incorporating herein the findings of fact set forth above, this
Court concludes and decrees the following:

The proposed application is authorized by the Water Right Determination and
Administration Act of 1969, c.R. S. S ~ 37-92.10 I, et seq. (2004) and can be implemented in
accordance with said statute.

The application is granted and a decree (ABSOLUTE) in the amount of 7.75 c.f.s.
(May I-October 31); 3.50 c.f.s. (November I-April 30) is hereby entered to preserve the
natural environment to a reasonable degree through the upstream and downstream points as
described in paragraph 9. The appropriation date for this water right is January 29, 1998.

The priority herein awarded was filed in the water court in the year of 1998 and shall
be junior to all priorities filed in previous years. As between all rights filed in the same
calendar year, priorities shall be determined by historical date of appropriation and not
