The first water right is natural springs which seeps into the drainage <br />area on public lands: located in the SE Y. NE Y. Section 10, Township <br />12 South, Range 89 West of the 6th Principal Meridian in the Gunnison <br />National Forest at a point described as 218 feet from the East section <br />line and 1591 feet from the North section line, Latitude 390 01' 54.3" <br />North and Longitude 1070 18' 50.3" West downstream approximately <br />100 feet to a point described as 774 feet from the East section line and <br />1515 feet from the North section line, Latitude 39001' 55.0" North and <br />Longitude 1070 18' 57.3" West. <br /> <br />b. The second water right is on public lands in the SE Y. NE Y. Section <br />10, Township 12 South, Range 89 West of the 6th Principal Meridian in <br />the Gunnison National Forest, in the natural channel at a point <br />described as 774 feet from the East section line and 1515 feet from the <br />North section line, Latitude 390 01' 55.0" North and Longitude 1070 <br />18' 57.3" West down to the headgate of the Downing Ditch, in the <br />natural channel at a point described as 1057 feet from the East section <br />line and 1570 feet from the North section line, Latitude 390 01' 54.5" <br />North and Longitude 1070 19' 40.0" West. <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />January 23, 2002 for a portion of the water right described in 4.b. above <br />and May 25, 2005 for the water right described in 4,a, and a portion of the water <br />right described in 4.b. above. See paragraph 8 below as to the amounts. <br /> <br />7. The water right described itt 4.b, was first applied to the above beneficial use <br />on January 23, 2002 and water right described in 4.a. was first applied to the above <br />beneficial use on May 25, 2005, by the action of the Colorado Water Conservation Board <br />under the provisions ofC,RS. ~ ~ 37-92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />2 <br />
