Since the subject water rights have historically been <br />used as a supplemental source of irrigation water, revegetation <br />of lands from which the water is removed is not required. <br /> <br />RULING <br /> <br />1. The findings of fact and conclusions of law set out <br />above are incorporated into this Ruling. <br /> <br />2. The plan for augmentation, and the change of water <br />rights are approved as described above. <br /> <br />3. The state Engineer and Division Engineer shall <br />administer this plan for augmentation and change of water rights <br />as described above. <br /> <br />4. Applicant shall be entitled to carry forward any stored <br />water and retain it in storage from one year to the next in order <br />to provide sufficient augmentation water in times of shortage, <br />subject to the provisions of any agreement with the reservoir <br />owner. <br /> <br />5. The State Engineer, in the discharge of his <br />responsibilities with respect to the processing of -applications <br />for permits to withdraw groundwater, shall recognize the <br />existence and operation of this plan for augmentation and shall <br />issue permits in accordance with this plan, so long as the plan <br />is ifl operation. Each permit issued by the State pursuant to <br />this plan shall incorporate within it by reference the terms and <br />conditions of this ruling. <br /> <br />6. Approval of the change of water right and augmentation <br />plan shall be subject to reconsideration by the Water Judge on <br />the question of injury to the vested rights of others for a <br />'period of 20 years from the date this decree is entered by the <br />Court. The Court also retains jurisdiction for the purpose of <br />revising this decree to comply with rules and regulations <br />promulgated by the State Engineer pursuant to C.R.S. ~ 37-90- <br />137 (12) (b) (I) . <br /> <br />7. It is further ordered that this Findings of Fact, <br />Conclusions of Law, and Ruling of the Referee shall be filed with <br />the Water Clerk and shall become effective upon filing, subject <br />to judicial review pursuant to statute and the Water Clerk shall <br />mail copies of this ruling as provided by statute. <br /> <br />8.
