Rio Grande and transmountain <br />surface water rights have been acquired by the District to replace these depletions. To <br />replace depletions at the time and place that they occur, up river water storage rights have <br />been obtained through agreements in Rio Grande, Santa Maria and Continental <br />Reservoirs. Through the use of reservoir releases and river diversion rights, the District <br />replaces depletions resulting from wells included in its Augmentation Program. <br /> <br />2.2 Water Availability <br /> <br />As previously mentioned, water is made available to the District's Augmentation <br />Program through several augmentation plans approved by the Water Court. The three <br />augmentation plans utilizing water native to the Rio Grande Basin, Case Nos. 03CW4l, <br />05CW13 and 07CW63 (decree pending) are based upon water measured in acre-feet per <br />year of consumptive use (C.u.). The two augmentation plans utilizing transmountain <br />water delivered through the Pine River Weminuche Ditch are based upon the amount of <br />water diverted and delivered to Rio Grande Basin and are not limited by the historic <br />consumptive use of that water in the Rio Grande Basin. Moreover, diversions through <br />the Ditch, whether for the District's augmentation plans or the irrigation of lands in <br />Water Division No.3, are limited only by priority and water availability at the headgate. <br /> <br />Table 2-1 includes a tabulation showing estimated yields of the various decrees and <br />estimated annual total.
