'i- <br /> <br />. <br /> <br />. <br /> <br />. ) <br /> <br />folEr.lORANDill1 OF AGREEr.'IENT <br /> <br />VAIL VALLEY CONSOLIDATED WATER DISTRICT <br />("District") and the COLORADO DEPARTMENT OF NATURAL RESOURCES <br />in order to settle Case No. 82CW328, Cases No. W-3628, <br />\>1-3631-3637, and all issues relating to a Green Mountain <br />Reservoir Water Service Contract for the District, agree as <br />follows: <br /> <br />1. The terms and conditions contained in the <br />proposed decrees in Case No. 82CW328 (attached as Exhibit A) <br />and Consolidated Cases No. W-3628, W-3631-3637 (attached as <br />Exhibit B), all of which are incorporated herein by this <br />reference, and the terms contained herein resolve all issues <br />between the parties to this Agreement regarding Case <br />No. 82CW328, Consolidated Cases No. W-3628, W-3631-3637, and <br />the use by the District of Green Mountain Reservoir water by <br />exchange either pursuant to the historic users pool or water <br />service contract as described in the District's request to <br />the Colorado River Water Conservation District on June 22, <br />1984. <br /> <br />2. District shall stock Black Lake annually with <br />2,500 pounds of catchable rainbow trout. The Division of <br />wildlife also shall stock Black Lake annually with 2,500 <br />pounds of catchable rainbow trout. Stocking shall occur in <br />increments three to four times during the year in consulta- <br />tion with the Division of wildlife regional personnel. <br /> <br />3. District shall stock Black Lake No. 2 with <br />2,500 pounds of catchable rainbow trout in years that 73 acre <br />feet of water from this facility was used the previous <br />winter. When only a portion of the storage in Black Lake <br />No. 2 is evacuated, the District shall restock the reservoir <br />in the same proportion that water is evacuated from storage <br />in Black Lake No.2. That is, the District shall stock 34.25 <br />pounds of catchable rainbow trout for every acre foot of <br />water evacuated. stocking will occur at the same time Black <br />Lake is stocked. <br /> <br />4. Agreement with Respect to Operation of the <br />Black Lakes. The District agrees to assume its respective <br />share of obligations relative to Black Lake and Black Lake <br />No.2 for structural integrity, maintenance, and operation. <br /> <br />a. Beginning on the date Black Lake is being <br />used pursuant to the decree in Case No. 82CW328, the District <br />shall assume obligation for structural integrity, maintenance <br />and operation for that portion of Black Lake which represents <br /> <br />.A <br />-- <br />
