Legal description of the stream segment through which an instream flow is <br />claimed: <br />The natural stream channel at the confluence of Johnson Creek at latitude 39° 42' <br />28"Nand longitude 107° 23' 11"Was the upstream temrinus and extending to <br />the headgate of the Baxter Ditch #1 at latitude 39° 3T 49"Nand longitude 107° <br />26' S0"Was the downstream terminus, being a distance of approximately 7.5 <br />miles. This segment can be located on Adams Lake U.S.G.S. quadrangles. <br />For administrative purposes only: <br />Upper Terminus = NE NW SEC 16 TWN 4S RNG 89W 6PM <br />1720' East of West Section Line & 640' South of North Section Line <br />UTM 43 97 837N 13 2 95 416E <br />Lower Terminus = SW NW SEC 12 TWN SS RNG 90W 6PN1 <br />] 270' East of West Section Line & 2470' South of North Section Line <br />UTM 43 89 390N 13 2 89 962E <br />5. Use of the water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br />6. Date of initiation of appropriation: <br />January 22, 2003 <br />7. The water was first applied to the above beneficial use on January 22, 2003, by <br />the action of the Colorado Water Conservation Boazd under the provisions of C.R.S. § § 37- <br />92-102(3) and 37-92-103(3), (4) and (10). <br />8. Amount of water claimed (ABSOLUTE): h>stream flow of 13.5 cfs (April 15 - <br />May 14), 24.1 cfs (May 15 -July 14), 13.5 cfs (July 15 -August 14), and 9.4 cfs (August 15 <br />- Apri114). <br />THE WATER REFEREE RULES: <br />The application is granted and a decree (ABSOLUTE) in the amount of 13.5 cfs <br />(April 15 -May 14), 24.1 cfs (May 15 -July 14), 13.5 cfs (July 15 -August 14), and 9.4 cfs <br />(August IS -April 14) is hereby entered to preserve the natural environment to a <br />reasonable degree through stream segment described in pazagraph 4 above. The <br />appropriation date for this water right is January 22, 2003. <br />The priority herein awarded was filed in the water court in the year of 2003 and <br />shall be junior to all priorities filed in previous yeazs. As between al] rights filed in the <br />same calendar yeaz, priorities shall be determined by historical date of appropriation and <br />not affected by the date of entry of ruling. The Applicant shall install and maintain such <br />measuring devices and keep such records as the Division Engineer may require for <br />administration of this right. <br />2 <br />
