lSF water right to request that such Domestic Wells be required to have a plan
for augmentation. 1-Iowever, if the l~~F stream segment defined herein is
designated as water critical by the CD171iR as a result, in whole or in part, of a
call by any water right other than the ISF water right decreed herein, the
CWCB shall not be bound by the provisions ofthis paragraph.
19. The teens and conditions set forth above are based upon facts and
circumstances related solely to this pn~ceeding, have been included in this
decree by way of compromise and set;lement of potential objections to the
subject TSF water right, and shall not rye construed as establishing precedent
regarding any other ISF water right. Nothing contained in this decree shall be
binding upon the C WCB other than in this proceeding.
20. The instream flow water right decreed herein shall not deprive the people
of the state of Colorado of the beneticia.l use of thaw waters availa6te by law
and interstate compact.
RULING AND DECREE OF THE WATER COURT:
The application is granted and a decree {A~iSULUTE) in the amount of 2.1 cfs
(Jan 1 -Dec 31 } is hereby entered to preserve the natural environment to a reasonable
degree through the stream segment described in pa~•agraph 4 above, The appropriation
date for this water right is January 25, 2006.
The priority herein awarded was filed in the water court in the year of 2006 and
shall be junior to all priorities filed in previous yews. As between all rights flied in the
same calendar year, priorities shall be determined by historical date of appropriation and
not affected by the date of entry of ruling. The Applicant shall install and maintain such
measuring devices and keep such records as the Division Engineer may require for
administration ofthis right.
It is ORI)F.RED that a copy ofthis Ruling shall be filed with the water clerk and
the Division Engineer and the State Engineer.
