Alternative Agricultural Water Transfer Methods -~ Grant Application F©rzn <br />January 2048 <br />The Colorado Division of Wildlife, and the Colorado Division ofi Parks have <br />expressed interest in leasing water from the Super Ditch Company to support wildlife <br />and recreation in John Martin Reservoir. The Lower District has also discussed <br />leases with the State Engineer and DNR for the purpose ofi a reserve supply to meet <br />the State's delivery obligations to Kansas under the Arkansas River Compact. <br />c} The program/project must at a minimum conceptually describe the technical, institutional, and <br />legal elements of the water transfer. Grant monies may be used to address one or more of these <br />elements. If grant monies are not requested for all three elements, the grant applicant must <br />describe how the applicant has or intends to address the elements, which are not included in the <br />grant request, tlu-ough other efforts. <br />To the extent that the grant request does not address comprehensively these <br />elements, they have already been addressed. See section on "Previous Studies" <br />under 1 above. <br />An optional Task G is included in this application, which would integrate all of the <br />information developed on the Super Ditch Company into a single report to facilitate <br />its use by others. <br />d} If grant monies are proposed for use for legal assistance then the use of those funds shall be <br />oriented toward advancing the knowledge of alternative agricultural water transfer methods and <br />techniques; not far preparation of a specihc water court case. The total requested funds for legal <br />assistance shall not exceed 40 percent of the total grant request. In addition, grant monies <br />proposed for use for legal assistance must be used to callaboratively address issues and concerns <br />related to agricultural water transfer. Funds shall not be used to solely advance the cause of the <br />project proponents. <br />Legal assistance is limited to analysis of potential antitrust issues associated with the <br />formation of the Super Ditch Company. This analysis is not specific to the Super Ditch <br />Company, but addresses an issue of statewide concern. The request for legal <br />assistance is less than 40 percent of the total grant request. <br />e) A minimum of a ld percent cash match of total project cost (past expenditures and "in kind" can <br />not be counted toward the 10 percent match}. <br />Applicant Lower District will contribute a 10 percent in cash match for the cost of the <br />total project. <br />5. Program/Project Evaluation Criteria <br />Please describe how the proposed program/project meets the following evaluation criteria. The criteria <br />are aimed at advancing alternative transfer methods from the literature to actual on the ground <br />projects/programs that provide reliable water supply and sustain key elements of the agricultural area <br />from which the water is transferred. The applicant should fully address and explain in detail how, and <br />the extent to which, the proposed projeet/program meets each of the criteria. However, it should be <br />17 <br />
